A. Cancellation Policy

Introduction

Consumers have a right of withdrawal in accordance with the following terms. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

Right of Withdrawal

You have the right to withdraw from this contract within 30 days without giving any reason.

The withdrawal period is 30 days from the day on which you or a third party named by you (who is not the carrier) took possession of the last item.

If the contract is for the regular delivery of goods over a specified period, the withdrawal period is 30 days from the day you or a third party named by you (who is not the carrier) took possession of the first item.

To exercise your right of withdrawal, you must inform us (kips eCommerce GmbH, Humboldtstr. 20, 60318 Frankfurt am Main, Germany, Email: support@kips-choco.de) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or email). You may use the attached sample withdrawal form, but this is not required.

To meet the withdrawal deadline, it is sufficient to send your notice of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse you for all payments received from you, including delivery costs (except for any additional costs resulting from your choice of a delivery method other than the standard, least expensive type of delivery offered by us), without undue delay and no later than fourteen days from the day on which we received your notice of withdrawal. We will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this refund.

We may withhold the refund until we have received the returned goods or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of your withdrawal. The deadline is met if you send the goods before the period of fourteen days has expired.

You will bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Exclusion or Early Expiry of the Right of Withdrawal

The right of withdrawal does not apply to contracts for the supply of goods that are liable to deteriorate rapidly or whose expiry date would be quickly exceeded.

The right of withdrawal expires early in the case of contracts for the supply of sealed goods that are not suitable for return due to health protection or hygiene reasons, if the seal has been removed after delivery.

The right of withdrawal also expires early for goods which, after delivery, have been inseparably mixed with other items due to their nature.

The right of withdrawal does not apply to consumers who, at the time of conclusion of the contract, are not residents of a member state of the European Union and whose sole residence and delivery address at the time of the conclusion of the contract are located outside the European Union.

Linked/Financed Transactions

If you finance this contract with a loan and later withdraw from it, you are no longer bound by the loan agreement either, provided both contracts form an economic unit. This is particularly the case if we are also your lender or if your lender makes use of our cooperation in granting the loan. If the loan has already been received by us at the time the withdrawal becomes effective or the goods are returned, your lender will take over our rights and obligations under the financed contract in relation to you. This does not apply if the present contract involves the acquisition of financial instruments (e.g., securities, foreign exchange, or derivatives). If you wish to avoid contractual binding as far as possible, make use of your right of withdrawal and also withdraw from the loan agreement, provided you are entitled to do so.

Please note:

  • The satisfaction guarantee only applies to kips products purchased directly via our website: https://kips-choco.de

  • It applies to one product unit per order of kips chocolate only.

  • Only the product price will be refunded. Any shipping costs are excluded.

  • The refund will be processed after checking that the conditions are met.

Please note that no refunds will be given based on individual variations in effect. Since our aphrodisiac chocolate is made from natural, plant-based ingredients, its effect may vary from person to person. We kindly ask for your understanding that this is not a valid reason for a refund.
